1 Acceptance of Terms
By creating an account on KiwiStrippers.com ("the Platform"), making a booking, or paying a deposit, you agree to be bound by these Terms & Conditions. KiwiStrippers.com is operated by Kiwi Events Limited. If you do not agree to these terms, please do not register or use our services.
2 Account Registration
2.1 Eligibility
- You must be at least 18 years of age to create an account.
- You must provide accurate and complete information during registration.
- You must have the legal capacity to enter into a binding agreement.
- In-person services are delivered within New Zealand only. Bookings are accepted from anyone internationally, provided the event takes place at a New Zealand address.
- Digital services such as webcam shows and online content are available to customers worldwide.
- For in-person bookings, the client must have a local contact available and contactable on the night of the event.
2.2 Account Types
We offer several account types, each with specific purposes:
- Fan/Customer Account: For browsing, booking services, and accessing content.
- Performer Account: For service providers listing their services.
- Business Account: For agencies, suppliers, and venues.
2.3 Account Security
- You are responsible for maintaining the confidentiality of your password.
- You must notify us immediately of any unauthorized access to your account.
- We are not liable for any loss resulting from unauthorized account access.
3 User Conduct
3.1 Prohibited Activities
You agree not to:
- Use the Platform for any illegal or unauthorized purpose.
- Violate any laws in your jurisdiction.
- Harass, abuse, or harm other users.
- Provide false or misleading information.
- Attempt to gain unauthorized access to other accounts.
- Use automated systems or software to extract data.
- Transmit spam, chain letters, or unsolicited communications.
3.2 Content Standards
- All content must be legal and appropriate.
- You must own or have rights to any content you upload.
- Content must not infringe on third-party rights.
- We reserve the right to remove any content at our discretion.
4 Booking & Services
4.1 Booking Process
- All bookings are managed by Kiwi Events Limited and are subject to performer availability.
- A booking is confirmed once a deposit has been received and confirmation has been sent to the client.
- Kiwi Events Limited assigns performers, takes payment, and manages the booking on behalf of the client.
- You must provide true and accurate information at the time of booking, including the event address, number of guests, and the nature of the event. Kiwi Events Limited reserves the right to cancel the booking without refund if false or misleading information is supplied.
- While we strive to provide your selected talent, availability is not always guaranteed. If a performer becomes unavailable, we will contact you and offer a suitable replacement.
Important: Not all talent shown on this website may be available for bookings. Please verify availability before making arrangements.
4.2 Cancellations
- A minimum deposit of $175 (inc GST) is required to confirm a booking. Higher deposits apply for larger bookings ($350, $575 or $1,150 depending on booking size, as shown on your invoice).
- Cancellations within 7 days of the event incur the full booking price; otherwise the deposit applicable to your booking is the cancellation fee, waived if a new date is booked within 14 days.
4.3 Age Verification
- The client is responsible for ensuring all guests at the event are aged 18 or over.
- Performers reserve the right to refuse or cease service without refund if underage guests are present.
- The client is responsible for the conduct of all guests and for ensuring a safe environment for the performer at all times.
4.4 Venue Responsibility
- It is the client's responsibility to confirm that the venue permits adult entertainment before the booking.
- If venue management refuses entry or does not permit adult entertainment, no refund will be issued.
4.5 Parking & Travel
- Any parking costs incurred by the performer in attending the event will be passed on to the client.
- Travel charges may apply for events outside the city centre in our service areas.
5 Payments & Fees
5.1 Payment Processing
- Payments are processed through secure third-party providers.
- We do not store credit card information on our servers.
- All prices are in New Zealand Dollars (NZD) unless otherwise stated.
- Prices are subject to change without notice.
5.2 Refunds
- Refunds are issued at the discretion of Kiwi Events Limited and are not guaranteed.
- No refunds will be issued based on personal preference or subjective dissatisfaction with a performer's appearance or style.
- If Kiwi Events Limited is unable to supply a performer for your event, any deposit refunded will incur a $21.00 administration fee.
- Credit or debit card refunds are subject to a third-party processing fee which will be deducted from the refund amount.
- Digital content purchases are non-refundable.
5.3 Overdue Accounts & Recovery Costs
- Any amount unpaid after the event date is an overdue debt.
- You will be liable for all costs we incur in recovering an overdue amount, including debt-collection agency fees and commission, legal costs, and administration fees, in addition to the original debt.
- Overdue accounts may be referred to a collection agency and reported as a payment default against your credit file.
6 Privacy & Data Protection
Your privacy is important to us. Please review our Privacy Policy for information about how we collect, use, and protect your personal information.
6.1 Data Collection
- We collect information necessary to provide our services.
- Personal data is protected in accordance with New Zealand privacy laws.
- We do not sell your personal information to third parties.
7 Limitation of Liability
Performers operate as independent contractors and are not employees, agents, or representatives of Kiwi Events Limited. Kiwi Events Limited is not responsible for actions outside the agreed scope of the booking.
Kiwi Events Limited is not responsible for:
- Actions by any performer outside the agreed scope of the booking.
- The quality, safety, or legality of services provided by performers.
- The accuracy of performer listings or user-generated content.
- Any disputes between clients and performers.
- To the extent permitted by law, personal injury, property damage, or loss arising during a booking.
In no event shall Kiwi Events Limited be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any services booked through it.
Kiwi Events Limited shall not be liable for any failure or delay in providing services due to events beyond its reasonable control, including but not limited to extreme weather, accidents, illness, vehicle breakdown, or government restrictions.
Nothing in these terms is intended to limit or exclude any rights you may have under New Zealand consumer law where such rights cannot be legally excluded.
8 Indemnification
You agree to indemnify and hold harmless Kiwi Events Limited, its affiliates, their respective officers, directors, employees, and agents, and any performers engaged through the Platform, from any claims, damages, losses, liabilities, and expenses arising from your use of the Platform, any booking made through the Platform, or violation of these Terms.
9 Termination
9.1 Termination by You
- You may close your account at any time.
- Contact us to request account deletion.
- Some information may be retained as required by law.
9.2 Termination by Us
- We reserve the right to suspend or terminate accounts that violate these Terms.
- We may terminate accounts that have been inactive for extended periods.
- Termination may occur without prior notice for serious violations.
10 Dispute Resolution
- These Terms are governed by the laws of New Zealand.
- Disputes will first be attempted to be resolved through direct negotiation with Kiwi Events Limited.
- If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.
11 Complaints
- Any complaints or issues regarding a booking must be raised with Kiwi Events Limited at the time of the event so we have the opportunity to resolve them.
- All complaints and refund requests must be directed to Kiwi Events Limited, not to the performer. Performers are not authorised to negotiate refunds, compensation, or variations to the booking on behalf of Kiwi Events Limited. Any such offers made directly by a performer are not binding on Kiwi Events Limited.
- Refunds will not be issued based on personal preference or subjective dissatisfaction with a performer's appearance or performance style.
- Kiwi Events Limited will investigate all complaints raised within the required timeframe and respond within 5 business days.
12 Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or Platform notification. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
